General conditions of sale

Preamble

These General Terms and Conditions of Sale apply exclusively between the company Wellbert-genealogie - Etablissement Wellbert, SIRET: 528 594 732 00034, domiciled at, 26 rue de la mairie – 44270 LA MARNE - FRANCE, and any natural person, personally or on behalf of a company, visiting or making a purchase via the wellbert-genealogie.fr site
These General Terms and Conditions of Sale may be subject to modifications without notice, the applicable conditions are those in force on the site on the date of placing your order. The fact of placing an order implies, on the part of the buyer, full and unreserved acceptance of these general conditions of sale.

1. Products offered for sale on the wellbert-genealogie.fr website

The products offered are graphic creations in dematerialized delivery, generally in PDF format, accessible using a login and password provided by Wellbert-genealogie at the end of the order.< /p>

Wellbert-genealogie reserves the right to refuse or cancel the sale of any product for legitimate reasons. The customer will then be informed by e-mail after the registration of his order by our services. In particular, the following cases constitute legitimate grounds: unavailability of the product at the time of preparation of the order; an accidental error on the product presentation sheet; abnormal customer demand in the product order; the existence of a dispute with the customer relating to the payment of a previous order or in the context of the return procedure (for an exchange or refund request); the customer's bad faith; and any other situation, act or attempt of a fraudulent nature and/or directly or indirectly targeting the interests of Wellbert-genealogie.

2. Product prices

The prices displayed are net and all taxes included or excluding tax depending on the mentions. Wellbert-genealogie reserves the right to modify its prices at any time but undertakes to apply the current prices displayed at the time of placing the order for a period of 3 months. Outside the European Union or in the DOM-TOMs, and according to the legislation in force in the delivery area, customs fees, duties and taxes may be claimed by the latter from the Customer. Wellbert-genealogie applies French and European Value Added Tax management laws specific to dematerialized products.

3. Payment and Terms of Payment

The customer has several payment solutions thanks to the PayPal Checkout system:

• By credit card: Payment by credit card allows access to products almost instantly. The cards accepted are Carte Bleue, Visa, Eurocard and Mastercard. Bank details are directly encrypted (to the maximum standards allowed by the authorities, i.e. 128 bits) and routed to PayPal Checkout. For security reasons, Wellbert-genealogie does not store banking information at any time during all transactions carried out on its servers.

• Pay in 4x free of charge with PayPal.

4. Receipt of Products / Right of withdrawal / Terms of return

Orders relating to dematerialized products cannot be canceled according to article of law L 121-20-2 of the consumer code relating to the right of withdrawal.
In the context of an order cancellation by the client, and with the prior agreement of Wellbert-genealogie's customer service, the latter must send Wellbert-genealogie an official request by email mentioning the surname, first name and invoice number to the following address: contact@wellbert .fr
The Customer will be reimbursed within 30 days of receipt of the request by Wellbert-genealogie, except in cases of force majeure or fortuitous events.

6. Retention of title

The products remain the property of Wellbert-genealogie until full payment of the price, plus interest if applicable.

7. Responsibility

Wellbert-genealogie can not be held responsible for the non-performance of the contract concluded, on the one hand in the event of force majeure, in particular disruption or total or partial strike, in particular of the postal services and means of transport or communications, on the other hand in case of fault of the customer. Wellbert-genealogie can not be held responsible for the consequences resulting from the misuse of the products sold on the site.

8. Data processing and freedoms – Protection of personal data

The information collected is intended for computer processing intended for the recording of your orders and the monitoring of our commercial relations. The recipient of the data is the company Wellbert-genealogie. In accordance with the general regulations for the protection of personal data (RGPD) in force since May 25, 2018, you have the right to access, rectify and delete information concerning you. 9. Intellectual Property

The operating licenses for software distributed by Wellbert-genealogie are granted to customers on a non-exclusive, personal and non-transferable basis, in accordance with the Intellectual Property Code. In any case, the client undertakes to respect the right of ownership that the author retains over his work.

10. Applicable law and competent jurisdiction

These general conditions are subject to French law, with the exception of the rules of conflict of laws. Any dispute relating to the execution or interpretation of the present, even in the event of recourse in guarantee or of multiple defendants, will be in the absence of amicable agreement of the exclusive jurisdiction of the court of Nantes, France.
